Certain front yard trees in Naples HOA were planted by the developer as part of the Site Plan of the Community, and as such are required to be maintained and if removed (for any reason) replanted in accordance with the site plan.

Prior to removing trees on a lot within Naples HOA, homeowners should review recent legislation including the Tree Canopy Law and the Roadside Tree Law, both of which became effective on March 1, 2014. These laws are under the jurisdiction of the Montgomery County Department of Environmental Protection who is also responsible for the enforcement of Montgomery County’s Forest Conversation Law

Selling Your Home
When selling a home within an HOA, sellers are required to provide a package of materials commonly referred to as a "Resale Package."
The management office can provide this package for a fee; a seller or their agent should contact the Management Office. The requirements of this package are listed in the Maryland Homeowners Association Act and include statement of assessments (current year and prior year), a statement of whether any of the fees or assessments are delinquent, management contact information, specific statements about legal actions, complete documents of the HOA. Naples HOA also includes financial information such as the budget and audit. A purchaser by law, has 20 days to review this information, and by purchasing a lot within Naples HOA, will automatically be subject to various rights, responsibilities and obligations. For complete information, reference the Maryland Homeowners Association Act, section 11B-106.
When a property is transferred (settlement), the settlement attorney contacts the Management Office and a written statement is provided to the settlement company that contains HOA information and funds that are to be collected at the time of the transfer of a property within Naples HOA.
